Ministers pull recess levers on procurement and insourcing as bigger state reforms await Parliament

The Cabinet Office has set out a recess-period package of procurement, insourcing and industrial-policy measures designed to give ministers immediate administrative levers while leaving the most consequential changes for future legislation.

Announced on 27 September, the package says utility companies will be expected to use procurement to support UK jobs and apprenticeships, with ministers warning that legislation will follow if companies do not comply.¹ It also creates an Insourcing Unit to help departments bring outsourced services back into government, expands the National Shipbuilding Office’s remit over civil shipbuilding, and confirms that a new Cefas research vessel will be procured through a UK-only competition using the Procurement Act 2023 national security exemption.¹

For Westminster, the significance is procedural as well as political. With Parliament in recess until 12 October, ministers are first relying on tools that do not require a bill: procurement guidance, departmental contracting decisions, exemptions already available under existing law, and the management of expiring outsourcing contracts. But the utilities element — if converted from expectation to enforceable duty — would need parliamentary time, legislative drafting and scrutiny.

What ministers can do now

The immediate power in the announcement lies in the government’s control over central public procurement and contract management.

Departments can be instructed to review outsourced contracts as they approach expiry, assess whether services should be brought in-house, and use the new Insourcing Unit for operational support. Cabinet Office minister Louise Haigh framed the move as a shift away from outsourcing in parts of Whitehall, saying the government would bring cleaning, catering and security jobs back into public employment where contracts end and insourcing is judged appropriate.²

The Morning Star reported that more than 1,000 outsourced Whitehall jobs were expected to be brought back in-house as contracts expire, linking the measure to Haigh’s wider conference announcement.³ The policy therefore begins less as a single statutory switch than as a rolling implementation programme. Departments will need to identify affected contracts, compare cost and service implications, manage transfer arrangements, and decide whether insourcing can be delivered without disrupting day-to-day operations.

Procurement rules also give ministers some immediate scope. The Cabinet Office said the Cefas vessel procurement would be limited to UK shipyards under the national security exemption in the Procurement Act 2023.¹ That is materially different from new legislation: it relies on an exemption already on the statute book, applied to a specific procurement on stated national security grounds.

The expanded role for the National Shipbuilding Office also sits largely within executive machinery. The Cabinet Office said the office would oversee civil shipbuilding procurement, extending its role beyond defence-linked work and making it a more central co-ordinating body for public-sector vessel orders.¹ In practice, departments and agencies planning relevant procurements can be brought into a more central pipeline, with ministers seeking to aggregate demand and give UK yards clearer visibility.

What needs legislation

The politically sharper promise concerns utilities. The government says utility companies will be expected to use procurement to support British jobs and apprenticeships, and that ministers will legislate if they do not comply.¹

That formulation matters. Expectations, guidance and political pressure can be issued immediately, particularly where government has relationships with regulated sectors or is signalling public policy objectives. But imposing binding procurement obligations on private or regulated utility companies would be a more significant intervention. It would need a statutory basis if ministers want enforceable duties, penalties or regulator-backed compliance.

Haigh used her Labour conference speech to cast the utilities measure as part of a broader attempt to “rewire” the state and ensure procurement supports domestic employment and training.² The Guardian’s conference coverage also highlighted the pledge that utilities would be told to use procurement to support British jobs, alongside the Insourcing Unit and marine research vessel announcement.⁴

If ministers proceed to legislation after Parliament returns on 12 October, the key questions will be scope and enforceability. A bill would need to define which utilities are covered, what counts as supporting UK jobs or apprenticeships, how obligations interact with procurement law and trade commitments, and whether compliance is monitored by departments, sector regulators or a central Cabinet Office function.

The recess timing means the announcement establishes the policy direction before the legislative vehicle is visible. Departments can prepare options and engage industry now, but they cannot create new legal duties for utilities without Parliament.

Shipbuilding as the test case

The shipbuilding elements are the clearest example of ministers combining existing powers with industrial-policy signalling.

The Cabinet Office said the new Cefas research vessel would be procured through a UK-only process, using the Procurement Act 2023 national security exemption.¹ The Independent reported that the wider package included £115 million for the marine research vessel and UK-only shipbuilding procurement commitments, while also noting opposition criticism over funding clarity and union support for skilled jobs and apprenticeships.⁵

Yahoo’s syndicated BBC report placed the vessel alongside other industrial announcements, including UK-built Royal Navy floating docks, while reporting criticism that the package required clearer financing.⁶

The policy logic is straightforward: public vessel orders can be used to maintain domestic capability, create demand for shipyards and support apprenticeships. The delivery challenge is equally clear. UK-only procurement narrows the field of bidders and may support domestic industry, but departments still have to run compliant competitions, control costs and ensure vessels are delivered on time.

The National Shipbuilding Office’s expanded civil remit is intended to address a familiar Whitehall problem: fragmented demand. If civil departments, agencies and arm’s-length bodies buy vessels separately, industry gets less certainty. A central oversight role could help co-ordinate pipelines, but only if departments accept that role and align their procurement plans accordingly.¹

The insourcing delivery problem

The Insourcing Unit may prove the most administratively demanding part of the package.

Bringing services back in-house is not simply a political decision. It requires workforce planning, payroll and pensions handling, management structures, facilities, and continuity planning. Where existing contracts are still live, departments will also need to avoid unnecessary termination costs unless there is a clear value-for-money case.

Haigh’s speech presented insourcing as a response to outsourcing in Whitehall support services and said the new unit would help departments act as contracts come to an end.² That timetable is important. The policy can advance without primary legislation where departments choose not to re-let contracts, but its pace will depend on contract expiry dates, departmental capacity and whether insourcing is judged affordable in each case.

For ministers, the unit also creates a central mechanism to push departments that might otherwise default to re-procurement. For permanent secretaries, it raises practical questions: who carries transition risk, how savings or costs are scored, and whether central support comes with enough specialist commercial, HR and legal capability.

A package split between signalling and machinery

The announcement gives Labour ministers a conference-season message about using the state to support domestic jobs, apprenticeships and industrial capacity. It also gives officials several immediate tasks: issue expectations to utilities, prepare possible legislation, build the Insourcing Unit, identify candidate contracts, and route civil shipbuilding procurements through expanded National Shipbuilding Office oversight.

But the package is uneven in its legal immediacy. The Cefas vessel procurement can proceed using an existing exemption. Insourcing can begin through departmental contract decisions. Expanded shipbuilding oversight can be created through government machinery. By contrast, compulsory procurement duties on utilities would require Parliament, and therefore political time after 12 October.

That makes the coming weeks a test of whether the announcement becomes a durable programme or remains a conference-season statement of intent. The administrative levers are available now; the statutory ones are not.
